Kimry and Charles "Steve" Wells appeal the Planning Commission's May 8, 2026 approval of a Major Use Permit and Mitigated Negative Declaration for a 183-unit deed-restricted senior living development at 1822-1864 York Drive. The appeal centers on off-site sewer improvements. The Board may deny the appeal, grant it and deny the permit, or continue the matter.

Staff recommendation: Deny the appeal, adopt the environmental findings and Mitigated Negative Declaration, uphold the Planning Commission's grant of Major Use Permit PDS2021-MUP-21-008, and require a Defense and Indemnification Agreement from the applicants.

03.Socially Equitable Cannabis Program - Amendments to the County Zoning Ordinance and Code of Regulatory Ordinances, with Certification of Final Program Environmental Impact Report, CEQA Findings and Associated Permitting and Licensing Fees (POD-21-001; ER-22-00-002)

County staff ask the Board to adopt the Socially Equitable Cannabis Program for the unincorporated area. The package includes zoning amendments allowing commercial cannabis facilities in certain agricultural, commercial and industrial zones, licensing and social equity ordinances, fee schedule changes, Board Policy B-076, and certification of the Final Program EIR with a Statement of Overriding Considerations. First reading is Aug. 19, second reading Sept. 2, 2026.

Staff recommendation: Planning & Development Services recommends adopting the CEQA Findings, certifying the Final PEIR, adopting the Zoning Ordinance amendments, introducing the licensing, social equity and fee ordinances, and adopting Board Policy B-076.
